SELECTMEN’S MINUTES
October 1, 2007
PRESENT WERE: Norman Hutchins, Roger Bergeron and Leo Ruel.
The Selectmen called the meeting to order at 7:03 PM.
Catherine Keefe re: 45 Hanson Lane Map 8 Lot 35-4
Mrs. Keefe’s son spoke to the Board of Selectmen about their appeal to the ZBA and being denied the variance for a misplaced building , being the garage.
Rick Keefe stated that his parents bought the home in 1992, it was built in 1988. They did not have a mortgage on the property. In 1992, the Keefe’s applied for a building permit for the garage. The plot plan provided at that time did not reflect the house in the correct location. It was explained that the Selectmen grant a zoning variance. After a short discussion, the Selectmen concurred that that they don’t feel that this was done deliberately, she is not a repeat offender, and that there are no serious environmental concerns.
Selectman Bergeron motioned to enter into a consent agreement with Mrs. Keefe and assess a fine of $1,500.00 and waive all but $500.00. Selectman Ruel second. All in favor. Mr. Keefe asked if the balance from the ZBA balance can be applied towards the fine, and the Selectmen agreed.
Deb Goulet has a 7:30 PM appt. with the Selectmen regarding her father’s property at 66 Rhode Island Ave.
Reports:
Assessor.: A memo from Carol Matheson stating that the tax rate is set at $9.65, and she made the corrections for the overlay figure.
Treasurer.: Reports submitted to the Selectmen. She stated that she has given the Selectmen a copy of the draft audit and that she has found issues.
Town Clerk/Tax Collector.: Shirley Harrison thanked the Selectmen for their nomination of her for the Ethel Kelly Memorial award. She didn’t get the award, but thanked the Selectmen for their kind words, and was honored just to be nominated. She also stated that the tax bill information is being transmitted to outsource. The due date is set for November 9th and the 2nd installment is due April 17th.
Building Insp / CEO/ Plumbing Insp.: John Brushwein submitted a report for month of September 2007.

Ordinance Review.: John Brushwein stated that the Ordinance Review Committee completed the review of the Shoreland Zoning. He stated that he is very impressed with the Ordinance Review Committee. They may not always agree but they are very thoughtful of each others opinion.
Selectman Bergeron motioned to appoint George Cheney to the Ordinance Review Committee as a non-voting member until June 30, 2009. Selectman Ruel second. All in favor.
Road Commissioner.:. Maurice St. Clair stated that he has finished his punch list of things needing to be done with the exception of Mrs. Green. He has ordered the catch basin and is waiting for it to come in. A discussion about the Oak Tree complaint on Williams Road. Maurice stated that it is not on Town property, he will contact the property owner and advise him. Maurice stated that they are paving Clarks Woods Road this week and he is getting quotes for Frost Road. He will get one from Carroll.
Parks and Recreation.: Lee Schatz stated that the Halloween Party is scheduled for October 27th at York County Fish & game and that Bunganut Park closed this week.
Conservation Committee.: Nothing to report.
Village Safety.: Nothing at this time.
Transfer Station.: Steve Marble stated that they pumped freon from the air conditioners and refrigerators this week. The informational hearing on the e-waste building is scheduled for October 4, 2007 at 7:00 PM.
Recycling and Waste Committee.: Nothing at this time.
Planning Board.: Roger Irving, Planning Board Vice Chair stated that he would like the Selectmen to seriously consider looking at the last ZBA decision regarding Nadeau. He stated that he feels it is a lack of professionalism on the part of the ZBA. He hopes that the Selectmen goes forward and takes court action against the ZBA because they completely disregarded the subdivision rules and regulations. The Planning Board try’s to enforce the regulations whenever people come before the Board and then the ZBA just allowed an illegal subdivision.

Zoning Board of Appeals.: Arthur Dumas would like to be appointed to the ZBA.
Selectman Bergeron motioned to appoint Arthur Dumas as a member to the Zoning Board of Appeals until June 30, 2009. Selectman Ruel second. All in favor.
The ZBA still has openings for two alternates.
Liaison for Fire Department.: Nothing to report.
Building and Maintenance Committee.: Nothing at this time.
ECO Maine Rep.: Nothing to report.
Minutes.:
Selectman Bergeron motioned to accept the minutes of September 17, 2007 as written. Selectman Ruel second. All in favor.
Unfinished Business.:
A discussion about the Animal Control Officer position. Steve Marble has applied. Selectman Hutchins explained to him that it could cause problems. if he was at the Transfer Station and got an ACO call, he could not be paid for both.
Selectman Hutchins stated that when it becomes budget time, he would like to restructure the position. Their Clerk has done some research for the Selectmen and explained the results.
Susan Taylor stated that anyone who had contacted Mike Clark from the DEP regarding the odors from Winterwood Farms should receive an Odor Survey Form. The DEP’s number is 1-888-769-1036.
New Business.:
A memo from Vicki Swenson regarding the General Assistance appendixes for 2007-2008. Selectman Bergeron read of the changes.
Selectman Bergeron motioned to hold a Public Hearing on Monday, October 15, 2007 at 6:45 PM to consider the 2007 2008 appendixes. Selectman Ruel second. All in favor.
The Selectmen signed the pole permits from Verizon for Frost Rpad
Selectman Bergeron motioned, after hearing from the Planning Board, he feels it is prudent to contact the Town Attorney to start legal with the Appeals Board. Selectman Ruel second. All in favor.

Mail.: The mail folder was reviewed.
The Purchase Requisitions and Time Off slips were reviewed and signed by the Selectmen.
Warrant:
The Selectmen approved the following amount for payroll: Gross $ 10,778.64.
The Selectmen approved the following amount for payroll: Net $ 9,598.64.
The Selectmen approved the following amount for Accounts payable: $ 60,853.67.
